Unless otherwise indicated, the contents of this Site are the property of BoomerTowne.com and are protected, without limitation, pursuant to U.S. and foreign intellectual property laws. You may download material displayed on the Site for non-commercial, personal use only, provided you also retain all copyright and other propriety notices contained in the materials. 5. The trademarks, logos, and service marks (collectively the “Trademarks”) displayed on the Site, are registered and unregistered Trademarks of BoomerTowne and others. Nothing contained on the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of BoomerTowne or the third party owner of such Trademark. Your misuse of the Trademark, or any content on the Site, except as provided in these Terms, is strictly prohibited. You are also advised that BoomerTowne will aggressively enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.
6. BoomerTowne has not reviewed all of the sites linked to the Site. Thus, BoomerTowne does not endorse, make any representations and is not responsible for the contents of any off-site pages or any other sites linked to the Site. Your linking to any other off-site pages or other sites is at your own risk.
7. If you are creating or accessing a BoomerTowne member account or earning or attempting to earn BoomerTowne Points regardless of the means, you agree to the following additional terms:
   
   1. You agree that you are at least 18 years of age, are a resident of the United States of America or Canada if you are earning or attempting to earn BoomerTowne Points, and that the name and contact information provided in your BoomerTowne member information is true and accurate for you personally;
   2. You agree that you will not register more than one BoomerTowne member account and acknowledge that no more than four account holders can share a common household;
   3. You agree that all BoomerTowne Points earned in your BoomerTowne account will be earned by you personally and that you will not permit others to access or use your account;
   4. You agree that you will not access or use the Site, or allow or permit your account information to be used to access or use the Site, in connection with: (a) any harmful or malicious (in BoomerTowne’s sole discretion) code, scripts, or routines, such as automated bots, macros, viruses, trojan horses, worms, time bombs, cancel bots, or other programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or information; (b) automated code, scripts, bots, macros, or routines designed or intended to earn BoomerTowne points; or (c) internet browser plug-ins, tools, or features, or external internet applications intended to facilitate the accumulation of BoomerTowne Points;
   5. You agree to only access and use the Site to earn points for your BoomerTowne account using manual clicks and typed information that are personally entered by you;
   6. You agree to keep your password confidential and to notify BoomerTowne in the event that your password is comprised. Unless you notify BoomerTowne that your password has been compromised, you agree to be responsible for all account activity; and
   7. BoomerTowne may terminate your account for any or no reason and/or revoke your ability to collect BoomerTowne Points, your BoomerTowne Points, or your rewards associated therewith at any time, with or without advance notice. You agree that you are not entitled to receive any rewards unless BoomerTowne determines, in its sole and absolute discretion, to provide a reward.
8. This Agreement represents the entire agreement relating to your use of this Site. BoomerTowne’s failure to enforce any right or provision of this Agreement does not constitute a waiver of that right or provision. BoomerTowne. may at any time revise these Terms by updating this posting and presenting them to you upon login. You agree to be bound by any such revisions and should therefore periodically visit this page to review the then current Terms to which you are bound. BoomerTowne may, in its sole discretion, terminate or suspend your access to all or part of the Site for any reason, including, without limitation, breach of this Agreement.
9. You consent and submit to the exclusive jurisdiction and venue of the state and federal courts governing Waukesha County, Wisconsin, U.S.A., for the resolution of any disputes relating to your obligations under these Terms, your relationship with BoomerTowne, and your use of the Site. You agree that in the event that BoomerTowne files suit or engages in other legal process to enforce these Terms, BoomerTowne shall be entitled to recover its reasonable attorney’s fees and costs in connection with such enforcement efforts.
